Freedom of establishment within the European Union ensures that any EU citizen may set up an undertaking, and any undertaking from an EU Member State may set up an establishment, in his country of choice within the European Union. However, foreigners must also satisfy the requirements of national industrial law governing the setting up of companies so that nationals are not subject to stricter rules than foreigners.
In the case of skilled trade activities, the Handwerkskammer (Chamber of Skilled Trades) must examine whether the skilled trade activity to be pursued must be entered on the skilled trades register and whether the necessary requirements have been satisfied. Anyone who wishes start up a business must register it with the Gewerbeamt (business registration office) of the municipal or local authority where the business is to have its registered offices. Self-employed persons are exempt. They are not registered with the business registration office but with the Finanzamt (tax office).
People setting up undertakings in Germany can obtain information and advice from chambers of industry and commerce, chambers of skilled trades, professional associations and financial institutions.
